Race Discrimination - What is Race Discrimination?

Race Discrimination is when someone decides to treat another in an unsatisfactory way due to their race. This is in relation to:

  • Recruitment
  • Training
  • Promotion
  • Selection for redundancy

because of their

  • Race
  • Colour
  • Nationality
  • Ethnic origin

It is unlawful in employment to discriminate, either directly or indirectly, on the grounds of race, colour, nationality or ethnic origins under the Race Relations Act of 1976

Indirect Discrimination is when an employer enforces a requirement, condition or practice on someone that a certain race, colour, nationality or ethnic origin cannot fulfil. An employer could impose a requirement specifying that the job can only be fulfilled in practice by a smaller proportion of that ethnic group.

Genuine Occupational Qualification is when an employer wishes to recruit someone from a certain ethnic group because the nature of the job demands it, for example, dramatic performances and certain welfare work.

"Can claims be made to an employment tribunal?"

  • If you feel that you have been discriminated against, you can bring a complaint to an employment tribunal within three months of your complaint.

  • There are no length of service or age requirements to bring a claim.

  • You do not have to have left employment before making a tribunal claim.

  • There is no upper limit on the amount of compensation a tribunal can award.
